Buyer Warning

I don't usually do this but I feel that you should be warned. I sold a
car to a "Gary Banks" in the UK recently. He requested that I do some
things to "help him out". I rewired the turn signals, changed all the
bulbs and disabled the reverse lamps so they would meet the UK
standards. I also added windshield washers (nice vintage piece too)
and made lots of misc repairs. Put the charges on MY credit card for a
new title as a favor. He complained that he was on a tight budget, so
gave him a great deal on a great car (some may remember it as "The
Georgia car") The whole deal was a pain and he refuses to pay me what
he owes. I did not charge him for several things anyway.

I just got an email from him (he obviously did not realize it was me)
asking about a car I have for sale. So he must be in the market again.
I'm not telling you what to do, just keep in mind his track record
here. Get all your money upfront.

Justin Banks is not a relative as far as I know. If you made the
deal and all went well, you're OK.

Garry is from Chartmoor Road, Leighton Buzzard, England. Does that
help?

I would like the opportunity to respond to this and set the record
straight. I decided to buy my first Amphicar last year and after looking
at a few advertised on ebay, I found the Amphicar Lovers Group and the
car in question advertised for sale on the forum. Buying a car in a
different country without seeing it is always a risk and I was really
pleased that I thought I had found someone selling a car who was
knowledgeable about these cars and who I thought I could trust to give
me an honest description and appraisal of the car.

However, when I received the car I found he had made many
mis-representations to me about the condition and state of the car. To
list just a few, the gearbox was shot, the starter motor was shot and
had to be replaced before I could even start the car, the transmission
mounts were held on by hose clips (that he told me was a permanent
repair) and there were a lot of parts that he said had been replaced on
the car when they clearly had not. Its true he did carry out a re-wire
mod of the rear indicators and fit a winscreen washer set up, but
offered to do this in the price we agreed for the car and then only
started asking for more money after. In addition to this, when he talks
about the new title document he paid for, he neglects to mention that I
sent him a cheque for $140.00 to cover this. To this date (4-months
later) I have never received this title document? At the time he came up
with some half baked excuse about the paperwork being returned from the
department that issues the title because of an admin screw-up, but who
knows the truth with this guy?

John, before I agreed to buy the car from you we exchanged numerous
e-mails in which I asked you many very specific questions as to the cars
conditions, exactly what faults there were and any items that were
incomplete or missing from the car. I still have copies of all of these
e-mails including your reply's. I also have a copy of the cheque I sent
you for the title document, that I have never received? If you really
want to get into a spitting contest about this, then hey lets go..! Lets
make all of the e-mails public on the site about what you told me about
the car and lets have David Chapman in the UK inspect the car to give an
honest and expert opinion. I have nothing to hide and have no problem
doing this.

I am prepared to take the hit on the state of the car and put it down to
experience, but when you come on here telling everyone I owe you money
then I will defend myself. As I say I know what was agreed and I have
the correspondence between us to back it up

Gary Banks

Well there are quite a few inconsistencies here which I can back up
as well. At any rate there are some who know that car and driven it.
It's a 40 year old car that came w/o warranty and EVERY question was
answered honestly and with integrity. I offered to take any photos
you want "even if it is a single bolt" and sent them all as
requested.

The gearbox was shot?!?!?! BullS***!!! Drove fine the 3+years I had
it. No noises no problems. This is the 1st time you said anything
about it. What is "Shot" exactly?

I told you that the "PERMANANT" fix for the mounts was to drill thru
the mounts and install longer bolts like they do in the German club.
The clamps were NOT a permanent fix. I said they would hold fine
until you installed the bolts. No need to replace the expensive
mounts, just add the bolts.

Starter motors and most mechanical components that are 40+ years old
should be expected to fail w/o warning. I have no control over the
many whom I would guess probably tried to start the car while in
transit to the UK. I would guess they cranked it quite a bit before
finding the timer button, if they figured it out at all. Once again,
worked great here EVERY time I started it for the past 3 years.

How can you tell if a part was replaced or not? Can you point out
the bad used parts that I replaced with good used parts??? Can you
tell me the 5 knobs I replaced VS the ones I didn't, what about the
2 broken lenses and ciggarette lighter components I replaced? (plus
other parts), The starter solenoid is new, the door seals are new
too. What about the $150 cracked prop I replaced? Can you tell me
which one?? THE $200 wiper arm I need badly, is on your car as well.
So don't tell me I didn't replace anything!!! The seal in the trans
is new as well. It was not an easy job to repair.

The title from Broadway title must be in the mail right now. My CC
was just charged $149 on Nov 3rd (Sorry Gary, I thought it was $165,
it is only $149) I have no control over how long they take. They did
say it would be a MINIMUM of 8-12 weeks. Call them about it. I paid
the $16 out of my own pocket to overnight your stuff back to them
after the 1st problem to expedite it.

From my bank statement;
11/03/05 $ -149.00
PURCHASE 11-02-05 BROADWAY
AUTO SALES INC205-323-3256 AL
305980

In conclusion, the car was described accurately, many photos were
provided and the opportunity for any others was presented several
times. I told you to have somebody inspect the car if you like, you
declined. I have NOTHING to hide here. I admit I may be slow getting
packages out sometimes, but I have never mis-represented anything to
anyone.

I asked you on several occasions (at least 4, I believe) to "send me
extra money for what you think the extra work might be worth." I
tried to be the nice guy but EVERY time it was summarily ignored. Be
sure to look over your emails for those tid-bits too.

I have sold a number of Amphicars and not one of those people were
unhappy as far as I know. I have a reputation that that I am honest
in what I sell. I have nothing to hide and everything to loose. You
got a great deal on a super car. The paint is not top shelf, but you
did not pay for a car with a top shelf paint job. Other than that,
the car is a keeper.

I could have gotten lots more for it here, but I wanted to help out
a guy "across the pond" where Amphis are scarce who wanted an Amphi.
I got kicked in the props for being a nice guy...

Now the record is straight.
